TERMS & CONDITIONS

The following Terms and Conditions are in addition to the standard Terms and Conditions of www.wine-source.com and its affiliated web sites. They supersede the standard web site terms when referring to transactions between buyers and sellers which are utilizing the Wine Source Exchange and Wine Source Collection (WS Exchange)

The Access to WS EXCHANGE is Free for People storing at Octavian, LCB in UK or Grands Crus Storage in Bordeaux

If you do not have an account with Octavian, LCB or GCS you will have to take a yearly Subscription of 100 Pounds/ Euros for prime storage with an unlimited number of transactions afterward (this offer apply to private collectors only and not wine professionals)

We only sell wines where we are securing that our customers are going to have a quality purchase, have a strong traceability and the wines are readibily available

We need a guarantee that the wines you are selling are in good conditions, this is why we need to inspect them and place them in a pristine storage location once done

Quality of the product is tied to its history, this means that to ensure a quality transaction we will ask and check:

• where the wine was purchased
• when it was purchased
• how the wine was stored
• whether it is still in owc (original wooden case from the property)
• whether the labels have been damaged or are in perfect conditions
• the level of the wine in the bottles (shoulder, neck, high neck)
• how long the wine has been stored in its last location

And any other point we may deem as relevant based on the above information. This is to ensure that you get the maximum price possible for your wine but also that the buyer is making a quality and rightly priced purchase

If you have an account with LCB or Octavian we will work with them to control the wines and then put them for sale without moving them

If you are in UK and do not have an account with LCB, Octavian we will store the wines you sell in consignment at London City Bond and untertake our best efforts to sell them on your behalf

If you are in the Eurozone, we will move the wines to Grands Crus Storage or another of our prime cellars based on your location.

Pricing : we will offer the service for a 10% fee on the final sales price

The sales price will be determined jointly based on wine condition and market pricing, should we not be able to agree on the sales price we reserve ourselves the right not to sell a given product

Our Commitments:

Once you decide to sell your wines with the WS Exchange it is very likely that they will be sold within a month to either wine collectors, or the wine professionals.

Should you not have sold your wines after 30 days, we will either ship them back to you with a certificate of value and quality or continue to store them for you in optimal conditions should you decide to get your wines back you can do so at any time in the process prior to a sales transaction.

All your information will remain strictly confidential and will not be shared to any 3rd party unless absolutely necessary in the process.

Once your wines will have been sold, paid online and transferred to the buyer, the payment of the wines minus our sales fee of 10% of the net transaction will be transferred to you within maximum 5 working days of the completion

Wine Source will undertake the best efforts to screen and check all the wines sold on its platform www.wine-source.com, we undertake a thorough evaluation process to secure that each transaction is meeting the best business practices and that the sellers and buyers have a good experience on the platform, we cannot however guarantee that a seller would try to bypass all the controls of a wine to sell a counterfeit.

Should a wine be proven a counterfeit by having an expertise with the chateau/producer, the funds associated to a transaction where a counterfeit would be highlighted would be put in escrow till the property producing the wine (all transactions above 5K) or expert sommeliers (all transactions challenged and below 5K) would have put a professional evaluation on the wines.

Should the wine be genuine according to the producer and should the delivery have been executed, the transaction would become full and final, should the wine be seen as counterfeit by the producer, the transaction would be cancelled, the wines returned to the seller at it own costs and the funds reimbursed to the buyer.

All materials, information and Intellectual Property on www.wine-source.com and its affiliated sites belong to Kal Wine Source sarl and its daughter companies.

All breach of IP, distribution of confidential information or sub licensing of the access granted will result in the termination of the subscription.

All wines stored on behalf of our subscribers are always stored on behalf of the subscriber and remain their property at all times, the wines can be shipped to the subscriber or a designated person at their request, on demand by email, partially or in full, at any time as per the subscriber request. The only fees being charged will be the associated duties and Vat if cleared or simply the transportation if the goods remain in bond. All goods stored are being stored with the highest standards and are fully insured against loss or theft.

All the transactions handled in UK are under the commercial law of the London court, all transactions in the Eurozone are under the commercial laws of France.
